These Terms of Service ("Terms") govern your access to and use of tradinghabits.com and any related content, programs, tools, journals, courses, community features, or services (collectively, the "Services") offered by Trading Habits ("Trading Habits," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old, and legally able to enter into a binding contract, to use the Services. By using the Services, you represent that you meet these requirements and that your use of the Services complies with all laws and regulations applicable to you, including those of the jurisdiction in which you reside and any jurisdiction in which you trade.
Certain features of the Services may require you to create an account. You agree to provide accurate, current, and complete information, to keep that information up to date, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use of your account.
Trading Habits provides educational content, coaching, courses, journaling tools, templates, and related resources intended to help traders build discipline, structure, and process around their own trading. The Services are educational and informational in nature. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.
You are solely responsible for your own trading and investment decisions. You should independently evaluate any strategy, calculation, or information discussed through or produced by the Services, and consult a qualified, licensed financial, tax, or legal professional before making any trading or investment decision. Trading Habits is not affiliated with, endorsed by, or acting on behalf of any broker-dealer, exchange, clearing firm, or market data provider referenced or compatible with the Services, and no such entity has reviewed or approved the Services.
You are solely responsible for independently verifying any calculation before relying on it, including by cross-checking figures with your broker, a licensed professional, or your own independent analysis. Trading Habits disclaims all liability for trading, investment, or financial decisions made in reliance on any calculator or tool output.
Trading financial instruments — including stocks, options, futures, forex, and cryptocurrencies — involves substantial risk of loss and is not suitable for all individuals. Options trading in particular carries a high degree of risk and can result in the loss of your entire investment in a short period of time. Past performance, whether actual or hypothetical, is not necessarily indicative of future results, and no representation is being made that any account will, or is likely to, achieve profits or losses similar to those discussed through, or estimated by, the Services.
Hypothetical performance disclosure: Any example, scenario, projection, or calculator output referenced through the Services is hypothetical in nature. Hypothetical performance results have inherent limitations, unlike an actual performance record; they do not reflect actual trading, and because trades have not actually been executed, results may under- or over-compensate for factors such as liquidity, slippage, commissions, fees, taxes, and the emotional impact of real capital being at risk. No representation is being made that any account will, or is likely to, achieve profits or losses similar to any hypothetical results shown.
You acknowledge that you may lose some or all of the capital you trade with, that leverage and derivatives (including options) can amplify losses beyond your initial investment in some cases, and that you assume full responsibility for that risk. Nothing in the Services should be interpreted as a guarantee against loss.
Some Services are offered for a one-time fee or on a recurring subscription basis. Prices, billing terms, and any applicable refund windows will be presented to you at the point of purchase and are incorporated into these Terms by reference. Unless otherwise stated at checkout, fees are non-refundable once access to paid content has been granted. You may cancel a recurring subscription at any time; cancellation takes effect at the end of the then-current billing period, and no partial-period refunds will be issued unless required by law.
When using the Services, you agree not to: (a) violate any applicable law or regulation; (b) reproduce, resell, or redistribute any paid content without authorization; (c) reverse engineer, scrape, or attempt to extract the underlying materials or code of the Services; (d) impersonate any person or entity; (e) upload harmful code or interfere with the operation of the Services; or (f) harass, abuse, or harm other users in any community or discussion feature we may offer.
All content on tradinghabits.com — including the Trading Habits name, logo, tagline "Better Habits. Better Trading.," course materials, templates, journals, articles, graphics, and design — is owned by or licensed to Trading Habits and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms or a separate written license, you may not copy, modify, distribute, sell, or create derivative works from any part of the Services.
If the Services allow you to submit journal entries, comments, reviews, or other content ("User Content"), you retain ownership of your User Content. By submitting it, you grant Trading Habits a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that User Content solely in connection with operating and improving the Services. You are solely responsible for the User Content you submit and represent that it does not infringe any third party's rights.
The Services may reference or link to third-party websites, brokers, data providers, or tools that are not owned or controlled by Trading Habits. We do not endorse and are not responsible for the content, accuracy, or practices of any third party. Your use of any third-party service is governed by that party's own terms and policies.
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any results — including trading results — will be achieved by following the content offered through the Services.
To the fullest extent permitted by law, Trading Habits and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost trading profits, lost data, or trading losses, arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these Terms or the Services will not exceed the amount you paid to Trading Habits in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Trading Habits and its owners, employees, and contractors from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for a violation of these Terms. You may stop using the Services at any time. Provisions of these Terms that by their nature should survive termination (including Sections 4, 5, 6, 9, 12, 13, and 14) will survive.
These Terms are governed by the laws of the United States and the state in which Trading Habits operates, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved on an individual basis, and you agree to waive any right to a jury trial or to participate in a class action, to the extent permitted by law.
We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
