FINRA Regulatory Notice 26-10 (effective June 4, 2026) eliminated the old day-trade-count pattern day trader rule in its entirety, including the 4-trades-in-5-business-days threshold and the $25,000 minimum equity requirement. Firms have an 18-month phase-in window, until October 20, 2027, to finish adopting the replacement.
The replacement is an "intraday margin" standard: instead of counting day trades, brokers now monitor each account's actual market exposure during the day and require any "intraday margin deficit" to be covered promptly, generally within 15 business days, with stricter consequences if deficits become a pattern.
If your broker has already switched, there's no more day-trade count and no more $25,000 PDT-specific threshold. The general minimum to open any margin account at all is $2,000 (a separate, pre-existing FINRA rule, unrelated to day trading specifically).
If your broker hasn't switched yet, the legacy math still applies for now: a margin account is flagged once it executes 4 or more day trades within a rolling 5 business day window, and equity below $25,000 restricts further day trading until it's brought back up.
